Welcome to Timeless Society. The terms “we”, “us” and “our” refer to Timeless Society (ABN 76 507 932 876).
Timeless Society operates this website and online store, including all related information, content, features, tools, products and services (collectively, the “Services”), for the purpose of providing customers with a curated premium retail experience. Timeless Society utilises the Shopify commerce platform, which enables the delivery and operation of the Services.
These Terms of Service (the “Terms”), together with any policies referenced herein, govern your access to and use of the Services and form a legally binding agreement between you and Timeless Society.
Please read these Terms carefully before using the Services. They contain important information regarding your legal rights, including limitations of liability and disclaimers of warranties.
By accessing, browsing, interacting with or using any part of the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Services.
SECTION 1 – ACCESS, ELIGIBILITY AND ACCOUNT RESPONSIBILITIES
By agreeing to these Terms, you represent and warrant that you are at least the age of majority in your state or territory of residence, or that you have obtained lawful consent to permit any minor dependents under your supervision to use the Services via devices you own or manage.
In order to access certain features of the Services or complete a purchase, you may be required to provide personal information including, but not limited to, your email address, billing details, payment information and shipping address. You represent and warrant that all information provided is accurate, complete and current, and that you have the legal authority to provide such information.

We endeavour to ensure that all product descriptions, imagery and specifications displayed on the Services are accurate. However, due to variations in device displays, lighting conditions and screen settings, actual product colours or appearance may differ from how they appear online.
To the fullest extent permitted by law, we do not warrant that product appearance, texture or colour will precisely match online representations or meet individual expectations.
Product descriptions, pricing, availability and specifications are subject to change at any time without notice. We reserve the right to discontinue products or restrict quantities offered on a discretionary basis.
SECTION 3 – ORDERS AND ACCEPTANCE
By submitting an order through the Services, you are making an offer to purchase products subject to these Terms. Timeless Society reserves the right, at its sole discretion, to accept or decline any order for any lawful reason.
An order is deemed accepted only once payment has been successfully processed and an order confirmation has been issued. Following acceptance, orders cannot be cancelled or amended.
In the event an order is declined, modified or cancelled, we will make reasonable efforts to notify you using the contact information provided at checkout.
All purchases are subject to our Returns & Refunds Policy, which forms part of these Terms.
You represent that all purchases are for personal or household use only and not for resale, redistribution or commercial export.
SECTION 4 – PRICING, PAYMENTS AND BILLING
All prices displayed on the Services are subject to change without notice. The price charged will be the price displayed at checkout at the time the order is submitted and confirmed.
Unless expressly stated otherwise, prices exclude shipping fees, customs duties, import charges and applicable taxes.
You agree to provide accurate and current billing and payment information and authorise Timeless Society to charge the selected payment method for all amounts due, including shipping and applicable taxes. You further represent that you are authorised to use the payment method provided.
SECTION 5 – SHIPPING, DELIVERY AND RISK
Delivery timeframes are estimates only and are not guaranteed. Timeless Society is not responsible for delays caused by shipping carriers, customs authorities or events beyond our reasonable control.
Title and risk of loss pass to you once the goods are handed over to the carrier.
SECTION 6 – INTELLECTUAL PROPERTY RIGHTS
All content forming part of the Services, including trademarks, logos, designs, text, images, graphics, videos, audio and software, is owned by or licensed to Timeless Society and is protected under Australian and international intellectual property laws.
These Terms grant you a limited, non-exclusive, non-transferable licence to access and use the Services solely for personal, non-commercial purposes. You must not reproduce, distribute, modify or exploit any content without prior written consent.
“Timeless Society” and all associated branding elements are trademarks of Timeless Society. Shopify trademarks remain the property of Shopify Inc.
SECTION 7 – OPTIONAL AND THIRD-PARTY TOOLS
The Services may provide access to tools or features supplied by third parties. Such tools are provided on an “as is” and “as available” basis without warranties or endorsements.
We accept no liability arising from your use of third-party tools and recommend reviewing applicable third-party terms before use.

The Services may contain links to third-party websites. We do not control and are not responsible for the content, accuracy or practices of third-party sites. Accessing such sites is at your own risk.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Timeless Society utilises Shopify to operate the Services. All transactions, however, are conducted directly between you and Timeless Society.
You acknowledge that Shopify bears no responsibility or liability for transactions, products or disputes arising from your use of the Services, and you expressly release Shopify from any related claims.
SECTION 10 – PRIVACY
All personal information collected through the Services is governed by our Privacy Policy and Shopify’s Privacy Policy. Information may be processed or stored outside Australia to facilitate service delivery.
SECTION 11 – FEEDBACK AND USER SUBMISSIONS
Any feedback, reviews or suggestions you submit grant Timeless Society a perpetual, irrevocable, worldwide, royalty-free licence to use such content for operational, promotional or commercial purposes, without compensation or obligation.
SECTION 12 – ERRORS AND OMISSIONS
We reserve the right to correct errors, inaccuracies or omissions and to cancel orders if information is incorrect, at any time without prior notice.
SECTION 13 – PROHIBITED USE
You must not use the Services for unlawful, deceptive, harmful or abusive purposes, including infringement of intellectual property, transmission of malware, or interference with site security. Violations may result in immediate termination of access.

You agree to indemnify and hold harmless Timeless Society, Shopify and their affiliates from any claims arising out of your breach of these Terms or misuse of the Services.
SECTION 18 – SEVERABILITY
If any provision is found unenforceable, the remaining provisions remain in full force and effect.
SECTION 19 – ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and Timeless Society and supersede all prior agreements or communications.
SECTION 20 – ASSIGNMENT
You may not assign these Terms without prior written consent. Timeless Society may assign these Terms without notice.
SECTION 21 – GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.
SECTION 22 – HEADINGS
Headings are included for convenience only and do not affect interpretation.
SECTION 23 – CHANGES TO TERMS
We reserve the right to amend these Terms at any time by posting updated versions on our website. Continued use of the Services constitutes acceptance of the amended Terms.
